The Friends of Dutch Charlie Creek v. Cal Fire and Redwood Timber Company will be heard in the Ukiah Courthouse, Courtroom H, 100 North State Street, Ukiah CA on August 27 at 2PM. Redwood Timber argues that there is “no evidence” that their “Lincoln Logs” and “Hot Tuna” Timber Harvest Plans will cause any additional sediment delivery into Dutch Charlie Creek which is one of the prime coho salmon habitats in California. Friends of Dutch Charlie Creek argue that there is potential for significant sediment delivery, which the Plans tacitly admit to but then do not assess as required by the California Environmental Quality Act. Friends also argue that Cal Fire’s partly AI-generated Official Responses to public comment are not legally adequate because they failed to respond to significant environmental concerns that were raised.
Cal Fire argues that this is just a disagreement between experts about the facts, and thus the court should defer to Cal Fire by default as the responsible agency. Friends argue that the Plans omitted essential information that is required by law, by not mentioning or assessing the sediment impacts from the Plans’ operations. Learn more at www.savethecoho.org.
